Law360: DC Circ. Urged To Invalidate H-1B Spouse Work Rule

A group of U.S. information technology workers has urged the D.C. Circuit to invalidate an Obama-era rule allowing the spouses of highly skilled visa holders to work in the U.S., saying that it was not within the U.S. Department of Homeland Security’s authority to issue the rule.

 

Last month, nonprofit group Immigration Voice and other intervenors told the appellate court that the district court was right to toss the suit brought in 2015 by Save Jobs USA, saying DHS was authorized to create the H-4 rule despite the Trump administration’s intent to rescind it. The H-4 visa program, which was created in 2015 by former President Barack Obama’s DHS, gives work authorization to the spouses of people with H-1B visas. Read the full story at Law360.
