Law360: Trump's Asylum Rule Hits A Wall As Calif. Judge Blocks It

A California federal court Monday temporarily blocked the Trump administration’s rule stripping asylum eligibility from migrants who cross the southern border outside of a designated port of entry, delivering an early victory to a group of immigrant advocacy organizations that claim the new policy is illegal.

 

U.S. District Judge Jon S. Tigar handed down the nationwide injunction preventing the administration from implementing the rule, which was issued jointly by the U.S. Department of Justice and the U.S. Department of Homeland Security earlier this month. The judge held that the rule is out of step with federal immigration laws as established by the Immigration and Nationality Act and flouts prior practice. Read the full article at Law360.
