City of Fremont v. Kotas
IRLI successfully represented three citizens of Fremont, Nebraska, who were chief petitioners and sponsors of a city initiative petition making it unlawful for any person or business to knowingly or recklessly lease or rent property to an illegal alien. Certain members of the Fremont City Council opposed the petition and sought to have it invalidated in state court. The case worked its way to the Nebraska Supreme Court who ruled that the City’s challenge was premature as the initiative had not yet even been voted on and adopted by Fremont citizens. The court also rejected the City’s argument that the initiative violated the one-subject rule.
