The Department of Homeland Security asked the D.C. Circuit on Monday to toss a challenge to an Obama-era rule allowing the spouses of highly skilled visa holders to work in the U.S., saying the agency is in the process of rescinding the rule.
Save Jobs USA, a group of American information technology workers, has argued that former President Barack Obama’s DHS violated the Administrative Procedure Act when it created the H-4 visa program in 2015. That visa program gives work authorization to the spouses of people with H-1B visas, which are reserved for highly skilled foreign citizens in specialty occupations. Read the full story at Law360.
