Law360: Battle Lines Drawn In Census Citizenship Question Suit

Over 50 individuals, organizations and municipalities have claimed sides in a U.S. Supreme Court case over the Trump administration’s decision to include a question about citizenship status in the 2020 census in advance of Tuesday’s oral arguments.

Filing amicus briefs in the case, some have argued that the citizenship question was justified in supplementing enforcement efforts under the Voting Rights Act, which prohibits discrimination against any U.S. citizens in voting, and the agency decision-making procedures outlined in the Administrative Procedure Act. Others have claimed that the citizenship question would depress response rates among non-citizens and Hispanic communities, leading to reductions in their federal funding and representation in Congress.
